Andrew S. Bosin is a partner in Nowell
Amoroso Klein and Bierman and a member of the firm's Litigation
Department. Mr. Bosin's practice focuses on the representation
of business entities including medical practices in commercial
disputes, shareholder and partnership litigation, real estate
litigation with an emphasis on contractual and fraud-based
claims, business torts and employment law. Mr. Bosin provides
counseling to both labor and management in employment matters as
to state and federal employment laws as well as litigation
services.
Labor and Employment
Mr. Bosin is a seasoned trial attorney having brought cases
successfully to verdict on six and seven figure claims. Mr.
Bosin has extensive experience handling labor and employment
disputes arising under the Law Against Discrimination, the
Conscientious Employee Protection Act, Title VII and the Family
Medical Leave Act. Mr. Bosin’s broad base of experience in
employment law includes counseling employers on complying with
various state and federal employment laws so as to minimize the
risk of employment related claims. Mr. Bosin successfully
represented a medical center client in a complex multi-million
dollar case involving interpretation of employment agreements,
covenants not to compete, out of network billing and shares in a
surgical center.
Mr. Bosin also has extensive experience representing employees
in cases arising out of discrimination based on race, national
origin, gender, age, disability, as well as in matters
concerning sexual harassment, restrictive covenants based on
radius restrictions, covenants not to compete, breach of
contract, violations of pubic policy and tort claims. Mr. Bosin
has extensive experience in negotiating settlement agreements,
severance packages and employment agreements. Mr. Bosin handles
traditional labor matters such as labor arbitrations and
mediations, wage and hour dispute hearings at the Department of
Labor and hearings held at the Division of Civil Rights.
Mr. Bosin has prevailed on appeal before the Appellate Courts of
the State of New Jersey. The New Jersey Appellate Division has
affirmed verdicts Mr. Bosin obtained in a pregnancy
discrimination case and in a hostile work environment case. Mr.
Bosin has extensive experience handling arbitrations and
mediations and hearings conducted by the New Jersey Department
of Labor, the New Jersey Department of Civil Rights and the
Railroad Retirement Board.
Healthcare
Mr. Bosin has an active practice representing medical practices,
pharmaceutical companies and device implant makers in a wide
array of areas including licensing and billing, intellectual
property, anti-kick back laws and labor and employment issues.
Mr. Bosin is a seasoned trial attorney in healthcare matters
having litigated cases involving covenants not to compete,
employment agreements, billing practices, out of network issues
and surgical centers.
Mr. Bosin frequently represents companies seeking medicare
licensing before the State of New Jersey and the Office of
Administrative Law. He also handles issues relating to billing
practices and out-of-network physicians. An increasing area of
need is counseling on the anti-kickback law, more commonly known
as “Stark” and “Codey.” The Stark Act prohibits physicians from
engaging in “self-referral” when referring patients elsewhere
for certain services. Stark prohibits physicians from referring
their patients to other entities for designated health services
payable by medicare when the physician or an immediate family
member of the physician has a direct or indirect financial
relationship with the entity. These referrals are commonly known
as “self-referrals.” As medical practioners become more and more
entrepreneurial, by opening medically related businesses for
themselves or in conjunction with hospitals such as physical
therapy and radiologic offices, doctors need sophisticated
advice and counseling on how to navigate the various
anti-kickback laws.
Mr. Bosin provides labor and employment counseling to medical
practices which includes negotiating and drafting employment and
shareholder agreements, covenants not to compete and severance
packages. Mr. Bosin also handles traditional labor matters such
as labor arbitrations and mediations. He represents clients in
wage and hour dispute hearings at the Department of Labor and in
hearings held at the Division of Civil Rights.
Mr. Bosin is an experienced health care litigator. He has
litigated many cases involving health and medical related
issues, for example trying to verdict a multi-million dollar
medical practice breakup which dealt with complexities such as
employment agreements, covenants not to compete, out of network
billing and shares in a surgical center.
